By submitting an order, you are accepting the Terms and Conditions of Phoenix Direct Ltd website. Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order for future reference. You may find it helpful to print a copy for information. When you register with the Phoenix Direct Ltd web site, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.
If any of your details change, such as your credit card billing address, you must inform Phoenix Direct Ltd as soon as possible. You may update your details by signing into your account on the Phoenix Direct Ltd web site, and update the relevant section. Please review our terms and conditions fully, before purchasing goods from Phoenix Direct Ltd. The following Terms and Conditions in no way affect either your Legal Rights or protection that you may be given by your credit card company. If you place an order it indicates that you accept these Terms and Conditions. If you do no agree with them do not proceed further with your order and let us know your concerns via the Contact Us link and will of course respond. We reserve the right, where necessary, to make changes to this website and to change our Terms and Conditions at any time.
The contract Between Us
Any contract for purchases made through this web site will be with Phoenix Direct Limited, registered in Guernsey, Channel Islands, British Isles, company registration number 50467. When you place an order on our website to purchase goods from us that constitutes an "Offer to Buy" from you. We accept this order when we send you an "Order Confirmation" (or "Shipment") email confirming that we have dispatched the goods you have ordered from us. That acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation (or Shipment) email, whether you receive that email or not. Phoenix Direct Ltd must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been received Phoenix Direct will confirm that your order has been received by sending an email (the Order Confirmation or Shipment email) to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Phoenix Direct Ltd acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Retention of Title
All ownership, title and risk of loss and/or damage in the goods purchased shall pass to you at the point and time at which the goods are allocated and/or charged to your card or account. The sale takes place in Guernsey and is concluded in Guernsey.
Use of Site
All text, graphics and photos published on this site are copyrighted and may not be used, reproduced or displayed without permission.
Orders are processed almost as soon as they are placed and it is not possible to cancel or change an order on the website once it has entered the dispatch process. If you no longer want the item you ordered, please return the item to us and you will receive a full refund for the price you paid for the item(s) If you return goods to us, unused, within 2 weeks of dispatch. We do advise you obtain proof of posting from your local post office. Please contact us for the returns address for your location.
The prices payable for goods as set out in the Phoenix Direct Ltd website are, inclusive of VAT for UK buyers. We will arrange for VAT at 20% due on your importation to be paid to HM Revenue and Customs as from 1st April 2012 VAT must be paid on importations of all goods from Guernsey into the UK. This procedure is for your convenience only and is specific for the importations you make into the UK. This arrangement does not change any of the relevant terms and conditions mentioned in this document. For the avoidance of doubt, you are and will remain the importer of all goods ordered by you and shipped to an address outside Guernsey and will at all times remain liable for any import VAT, Customs or other duty chargeable thereon. For purchases by UK businesses, no evidence of payment of UK import VAT can be provided.
If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to import VAT, duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Phoenix Direct Ltd has no control over additional charges in relation to customs clearance. Phoenix Direct Ltd recommend that you check with your local customs officials or post office for more information regarding importation taxes / duties that may be applicable to your on-line order. You will be the importer of the goods and responsible for any import VAT and duty that may be borne. In addition, any charges for import clearance will be borne by you, the customer.
Please note that when shipping goods from Guernsey, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of Guernsey, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.
The contract between us shall be governed by and interpreted in accordance with Guernsey law, and the Guernsey courts shall have jurisdiction to resolve any disputes between us.
